These Terms of Service (“Terms”) govern access to and use of Ophir Events (the “Service”), operated by Ophir Events (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Ophir Events lets hosts (“Hosts”) create and manage events, including invitations, guest lists and RSVPs, budget ledgers, seating charts, catering menus, gift registry links, and guest-submitted text messages, video messages, and photos (“Guest Media”). Guests access an event through a link provided by the Host and do not need a separate account.
You must provide accurate information when creating a Host account and are responsible for activity under your account and for keeping your login credentials secure. Each event requires an active plan (Short Term, Long Term, or Mega Host) as described on our pricing page. Plan pricing, hosting windows, and post-event data retention periods are as displayed at the time of purchase and are subject to change for future purchases.
One-time plans are billed once at purchase and are non-refundable except as required by law. Subscription plans (Long Term, Mega Host) bill on a recurring monthly basis until canceled and are processed by Stripe. You authorize us to charge your payment method for all fees incurred. You may cancel a subscription at any time; cancellation takes effect at the end of the current billing period.
Hosts are responsible for the guests they invite and for moderating Guest Media submitted to their event before making it visible to others. You may not use the Service to upload or transmit content that is unlawful, infringing, harassing, or that you do not have the right to share. We may remove content or suspend accounts that violate these Terms.
Host access to an event’s data is available for the hosting window and post-event archive period associated with that event’s plan, as described on our pricing page. After an event is archived, Host access may be limited or removed. We recommend exporting your data before an archive deadline. See our Privacy Policy for details on how data is stored and deleted.
We retain all rights to the Service itself. You retain ownership of content you or your guests submit (“Your Content”) and grant us a limited license to host, store, and display Your Content solely to operate the Service for you and your guests.
The Service is provided “as is” without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation.
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for loss of data, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim arose.
We may suspend or terminate access to the Service for violation of these Terms. You may stop using the Service and cancel your subscriptions at any time.
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
